Why brokerages need a written wire fraud policy
The FBI's 2025 Internet Crime Report logged 12,368 real estate fraud complaints and $275.1 million in losses. Business email compromise, where a criminal impersonates someone you trust by email, cost another $3 billion across all industries. Closings are a favorite target because large wires move on tight timelines.
Most of these attacks follow the same pattern. A criminal gets into or spoofs an agent's, title company's or lender's email, then sends new wiring instructions days before closing.
A written policy breaks that pattern. It covers four things: tell clients at the start that you will never send wiring instructions by email, verify every instruction or change by phone using a number you got independently, train agents to spot red flags, and know exactly who to call if money goes to the wrong place.
A written policy also helps when a client or insurer asks what your brokerage does to prevent wire fraud. If you are in Florida, the Florida Information Protection Act (§501.171) separately requires reasonable measures to protect personal information.
